In Republican-leaning states, most ICE arrests occur inside prisons and jails, while in Democratic-leaning states, the majority happen in public spaces such as workplaces and neighborhoods. This political divide reflects differing local policies and has sparked fierce debate over civil rights and enforcement tactics.

Community Arrests Surge in Blue States

In Democratic-led states with sanctuary policies limiting local cooperation, about 70% of ICE arrests take place in community settings. These include workplace raids, neighborhood roundups, and public space detentions. Many individuals targeted in these operations have no criminal records, drawing criticism from immigrant advocacy groups. A local Cincinnati official noted, “Arresting people in their workplaces disrupts families and communities.”

Prison-Based Arrests Dominate in Red States

Conversely, in Republican-leaning states where local authorities cooperate more with ICE, 59% of arrests happen inside jails or prisons after individuals are detained for other offenses. ICE officials attribute this to sanctuary policies that prevent ICE access to local law enforcement in blue states, forcing agents to focus on incarcerated populations in red states. This method is viewed as less disruptive but raises concerns about racial profiling in the criminal justice system.

Growing Partisan Enforcement Divide

Though differences in ICE arrest locations existed during Trump’s first term, the gap has widened significantly since last year. The evolving enforcement approach increasingly mirrors national political fault lines, with Democrats favoring sanctuary protections and Republicans pushing stricter immigration controls. Analysts warn this split complicates national immigration policy and enforcement consistency.

Sanctuary Policies Drive Enforcement Changes

Trump administration officials argue that sanctuary policies in Democratic jurisdictions leave ICE no choice but to conduct community arrests, claiming local police refuse to collaborate. “When local law enforcement won’t cooperate, ICE must act in the community to enforce federal law,” a DHS spokesperson said. Critics, however, say this undermines trust in law enforcement and threatens immigrant rights.
